ones, is Atill more fo; and no Time mult be loft in reducing the Court
to its original Eftablifhment.
Confidering the fimall comparative Portion of Territory which we
now poffels, and the offenfive Military Operations about to take place,
in Conformity to the Inftruélions which you will receive from Mr. Secretary Dundas in this Behalf;, which Operations, from their Nature, mult
in a great Meafurc leffen, if not entirely fulpend for a Time the Civil
Jurifdiation and Authorities, it feems abfurd to fuppofe that a Council
of Juftice, confifting of Eleven Members and One Prefident, who joins
tohis Situation that of Chief Juftice of Police, with a Procureur General,
muft not be fufficient for thc Adminifration of Juftice in all the Diftriéts
FOW in our Poffeffion.
Such of them as are not neceffarily employed at Port-au-Prince,
fhould taketheir Tour ofDuty, and be employed in the feveral Diftriéts;
fuch a Mode of Proceeding on their Parts, with the Affiftance of the
Juges de Paix of each Diftriet (who I underftand receive no Salarics)
would, no Doubt, render feparate and diflinét Courts of Juftice in thofe
Diftriets unneceffary for the prefent, and thercby produce a confiderable Saving to the Public.
Not having received from Sir Adam Williamfon, as I have already
mentioned, the Information required by my Letter of the 6th of
Oétober laft, it is not poffible to determine what Civil Offices may bc
requifite in the prefent Situation of Affairs in St. Domingo; but, pending Military Opcrations, they muft neceffarily be but very few, and
therefore the only Direétion that can be given on this Point, and which
His Majefty's Service, not lefs that the Intereft of the Colony, requires,
is, that Civil Appointments fhould be as limited in Number, and as
ceconomically paid, as poffible. For while the Military Conteft for the
Country continucs, little other than Military Authority ought to prevail; and upon that Principle, when no urgent Reafon operates to the
contrary, you ought to regulate your Conduét conformably to the
Powers vefted in you by your Commiffion, which both authorizes and
direéts you to be guided by the Law Martial, where Circumflances require it,
Intereft of the Colony, requires,

Capitulation, and Inftrustions oflis Majefty, affembled in the Prefence
of His Excellency Sir Adam Williamfon, Enight of the Moft Ilonourable Order cf the Bath, Governor and Commander in Chief of
Saint Domingo,have given it as their Opinion, Tharic is for the general
Good, to lxy before the King and His Minifters, the Situarien of the
Coleny cf Saint Domingo, and to prefent to Him the Pians of Adminifration by which it Ahould bc governed, which cannot be carried into
Efest in a more defrable Manner than by fending Depuries to
London.
This Refoirtion having been approved by the Guvemm.helaifigmified
his Confent, Thar the Colonial Council fhould choole Two or Three
Perfons of Ariét-Integrity, and fit Capacity to reprefent the Colony.
In confequence, the Colonial Council nominated and deputed Meffis.

TRANSLATION.
The CONSEIL SUPERIEUR of St.
DOMINGO, fitting at PORT-AU-PRINCE, was
compofed, in 1799, of
L-A Chief Magiftrate, who prefided over all the Councils of the
Colony.
This Magifrate was the Intendant ;--now he is Chief Juftice.
His Salary was 120,000 Livres "Currency, befides confiderable Fees,
&c.
IL-A Prefident who was allowed a fxed Salary of 24:000 Livres
Currency, independent of Fees, &c.
III.-12, Judges cr Counfellors with a fixed Salary, each of 13:500
Livres Currency - independent of which the Profits of each Place,
amounted in 1783 and 1789, to a Sum nearly equal to the Salary.
IV.-4 Couniellors Affeffeurs without any fixed Salary, but receiving
Fees, Sc.
V.-A Precureur General with a fixed Salary of 25,000 Livres Currency; -independent of which his Perquifites were fo confderable, that
this was confidered as one of the moit lucrative Places in the CoJony.
VI.-3 Subfticutes, Two only of whom had fixed Salaries of 6,003
Livres, not inciuding Fees.
VIL-The Greffiers and the Huifliers had no Allowance, neither
have they any at prefent.

OBSERVATIONS
1.-The Price of Provifions is O much increafed, that it would be
impofmible to fubfiit with the Aliowances fixed in 1789, unlefs the Fees
were added to them.
II.-In coupling the Salaries with the Fees; exifting in 1789, they
are at leaft equal to the Ailowances fertled fince the Re-eftablifhment of
the Tribunals.
111.-The Magiftrates and others who formerly held Places, had
Fortunes independent of the Profits of their Places ;-but now, every
one depends upon his Salary for his Subfifence, and the Magifrates
no Jonger receiveany Fees.
